A 4-year-old Tucson boy who was taken to the hospital in critical condition Thursday was beaten for up to an hour by both his mother and her boyfriend for “talking back,” court documents indicate.

On Thursday morning, Tucson Fire Department paramedics were summoned to an apartment in the 5400 block of East Williams Boulevard after being told a child had been found “drowning in a bathtub,” court documents state.

When the paramedics arrived, they found the boy unconscious, unresponsive and bleeding from his buttocks, court documents state. The boy’s heart stopped on the way to the hospital, but he was revived and arrived at the hospital in critical condition.

The boy’s mother, Jody Minley, 26, and her boyfriend, James Dwight Robinson, 27, told detectives the boy had been disobedient the night prior and had talked back to them, court documents state. Minley said she tried to make the boy hold 8-pound bottles of laundry detergent in each hand and when he refused, she and Robinson stripped him and gave him a “whooping” with a sandal, records show.

When the sandal broke, Minley said she taped it up and gave it back to Robinson so he could continue to beat the boy, court documents state.

Minley admitted to being frustrated with the boy and telling Robinson to deal with him.

Robinson told detectives the beating lasted 45 to 60 minutes straight, court documents state.

The “drowning” was reported the following morning.

“There was no indication that the boy had actually been under water or nearly drowned as was originally reported,” Tucson Police Sgt. Maria Hawke said in a news release.

Minley and Robinson were booked on suspicion of one count each of child abuse. Their bonds have been set at $500,000 each.
