A 67-year-old Tucson man found with dozens of child pornography images on his computer was sentenced to six years in prison on Monday.

Dennis Marklin Foster pleaded guilty to two counts of sexual exploitation of a minor. He was originally charged with 10 counts of the crime.

Foster had as many as 50 child pornography files on his computer at the time of his arrest, court documents say.

Foster had not accepted responsibility for his crimes and attempted to mitigate his actions by saying he had inadvertently downloaded child pornography, Deputy Pima County Attorney Virginia Aspacher  said.

“I think we need to focus on the victims in this case and not the defendant,” Aspacher said. “He is a risk to the children of this community.”

Foster fled the country after his initial arrest in December 2012. He was arrested in Mexico in September.

Foster’s attorney, Richard Lougee, said his client was a low-risk offender and that people who view child pornography are not necessarily inclined to commit abuse against children.

Foster, who had more than 30 supporters at the hearing, said he was ashamed of his actions and apologized for the pain he caused.

“I’m made up of many parts, and I’m sure that part of me is very immature and irresponsible,” Foster said.

Even if all Foster did was view images on his computer, he should have been aware that actual children suffer from the abuse inflicted on them in order to feed the demands of the child pornography industry, Pima County Superior Court Judge Richard Fields said.

“This part of you is not just immature; it’s downright evil,” Fields said.

Foster also must serve lifetime probation after his release from prison.
