A Sahuarita woman who was sentenced to 16 years in prison earlier this month for shooting her husband's lover in the back is being sued by her victim's husband.
John L. Lucas is seeking both punitive and compensatory damages from Dawn Wilbert, formerly known as Dawn Wear, for the Feb. 28, 2005, death of his wife, Annette Lucas, according to a lawsuit filed in Pima County Superior Court. Lucas is also seeking medical, funeral and burial expenses.
Wilbert, 39, was convicted of second-degree murder in January, and sentenced March 7, for driving to Desert Valley Landscaping, 11150 S. Nogales Highway and shooting Lucas in the back two days after learning that her husband, Ron, and Lucas were having an affair.
Lucas, a 36-year-old mother of two, was the company's office manager, and Ron Wear, a father of two, was the equipment manager.

At her trial, Wilbert told jurors that she went to the location to commit suicide, but the gun went off as she spun around to put it under her chin.
The Wears have since divorced and Wear is now using Wilbert as her surname.
Ron Wear was also listed as a defendant in the case. The lawsuit states that "at all relevant times defendant Dawn Wear was acting on behalf of her marital community."
Also listed as plaintiffs in the case are the Lucas' two children, Sean and Brittany, and Lucas' parents, Bill and Socorro Maria Falshaw.
