Last week 4th Circuit Judge Wilkinson wrote in his opinion preventing the administration's transfer of prisoners to El Salvador: "The Government is asserting a right to stash away residents of this country in foreign prisons without the semblance of due process that is the foundation of our constitutional order . . .and that because it had rid itself of custody that there is nothing that can be done."
On Saturday, Supreme Court Justice Alito wrote in his dissent from his Court's ruling to temporarily halt such transfers: "I refused to join the Court's order because we had no good reason to think that, under the circumstances, issuing an order at midnight was necessary or appropriate."
Just as the Justice's dissent was being released, an ICE busload of prisoners was on its way to a Texas airport for a flight to El Salvador. I'd say that was a good reason to act, and that there was something that could be done.
