PHOENIX — Supporters of the Empowerment Scholarship Account program declared victory Monday in blocking a reform initiative from going to the ballot.

Arizona’s Supreme Court says Republican lawmakers used “argumentative, speculative, and non-neutral” language to describe Prop. 212. But the measure still may not reach voters.

A bid to block Proposition 212 and its attempt to rein in voucher enrollment in Arizona claims, in part, that the measure should be knocked off the ballot because many circulators were unqualified to collect voter signatures.

A judge ruled that a Republican-backed measure targeting the Arizona Education Association is unconstitutional and cannot be on the November ballot because it combines unrelated issues, violating Arizona’s separate amendment rule.

Organizers for Protect the Vote Arizona say it's unlikely they have enough petition signatures to overcome the typical failure rate to get on the ballot.
