In the view of a sitting Justice and a former Attorney General, labeling the makeup of the Supreme Court as "legitimate" means that the thought process of four of the justices should consistently be "liberal," and the thought process of four justices should be "conservative," with the ninth justice being "non-partisan," consistently viewing matters from one side or the other. The swing vote.
It's unlikely that the framers of our Constitution had that in mind. So why the label? The newly confirmed justice is thought to be "conservative," suggesting that now the court isn't "legitimate." Inferring a violation of an act of Congress, or the Constitution itself. Or to their intent, that the confirmation by the Senate was illegal. What it's likely to mean is that what should've been approached by the Senate with a sense of neutrality has once again been politicized, and someone ran out of stones.
