New neighbors in an upstairs apartment on Tucson’s south side caused such a ruckus that framed photographs — including one of NASCAR driver, Dale Earnhardt, (a.k.a. The Intimidator) — hanging in the apartment below fell off the walls and shattered.
The husband-and-wife race fans tried to reason with the new neighbors in late August, but “they just give you attitude,” the couple reported to a Pima County Sheriff’s deputy.
The problem, said the couple, were the neighbor children upstairs who jump up and down day and night. While the deputy was at the apartment, he did not hear any of the noises the complainants described, according to the report.
When the third photo was broken, one of the downstairs residents went upstairs to tell the neighbor to “control the kids,” according to the report. “She stated the female ‘Got in my face and I thought I was going to have to duke it out with her.’ ”

After that encounter, in which the children’s mother cussed out the complaining neighbor, a man living in the upstairs apartment confronted the race fans asking, “You want me to come down and tape the pictures to the wall?”
The last straw for the couple was when the Earnhardt photo, a Christmas present reportedly worth $180, fell and was damaged, reducing its value as a NASCAR collectible.
The deputy told the couple “there were no criminal charges pertinent to their case, but if they wished to pursue for the damage done to the picture that fell and broke then they could take their neighbor to small claims court.”
